Terms of Service
1. Agreement to Terms
By accessing or using Hugboard ("the App"), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use our service. We reserve the right to modify these terms at any time. Your continued use of the service after such changes constitutes acceptance of the new terms.
2. Description of Service
Hugboard provides a digital, shared canvas designed for two people to draw and interact. Features include a daily drawing space, home screen widget integration, and a session archive. We strictly reserve the right to modify, suspend, or discontinue the App or any features at any time without prior notice or liability.
3. User Responsibilities & Content
You are solely responsible for your conduct and any content, drawings, data, or information that you submit, post, or display on or via the App ("User-Generated Content"). You agree not to use the service for any illegal or unauthorized purpose, or to harass, abuse, or harm another person.
Right to Terminate: We explicitly reserve the unilateral right to refuse service, remove any content, or terminate accounts for any reason at our sole discretion, without prior notice or liability.
4. Subscriptions, Payments, and Refunds
Certain features of Hugboard require a subscription (such as monthly, annual, or lifetime access). All subscriptions and payments are managed and processed entirely through the Apple App Store and third-party subscription management services.
No Refunds: Hugboard does not manage your billing and cannot issue refunds. All purchases are final and non-refundable. Any requests for refunds must be directed to Apple Support according to Apple's Terms of Service.
5. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. Hugboard expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the App will be uninterrupted, error-free, secure, or free from viruses or other harmful components. We are not responsible for the deletion, failure to store, or loss of any drawings, canvases, or other data maintained or transmitted by the App.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL HUGBOARD, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AGENTS BE LIABLE for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the service; (b) any conduct or content of any third party or partner on the service; or (c) unauthorized access, use, or alteration of your transmissions or content.
In no event shall our aggregate liability for all claims relating to the service exceed the greater of the amount you paid us globally or one hundred U.S. Dollars ($100 USD).
7. Indemnification
You agree to defend, indemnify, and hold harmless Hugboard, its officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the App or your violation of these Terms.
8. Intellectual Property
All content, features, and functionality of Hugboard (excluding the user-generated canvases) are owned by Hugboard and are protected by international copyright, trademark, and other intellectual property laws.
